Students question ‘affirmative consent’ bill designed to combat sexual assaults

'A pair of friends at Cal State Long Beach said the bill seemed well-intentioned, but questioned how practical it is when it comes to ensuring consent throughout sex with their partners.
“I feel like their hearts are in the right place, but the implementation is a little too excessive,” said Henry Mu, a 24-year-old biology major. “Are there guidelines? Are we supposed to check every five minutes?”
The remark drew laughter from his friend and fellow 49er, Sue Tang.
“If you were to do that, it would definitely kill the vibe,” said Tang, 27.
Lowenthal said affirmative consent means an individual “must say ‘yes,’” and “if an individual says nothing, that doesn’t imply consent.”

Critics of SB 967 say the “one-in-five” women statistic is dubious, and is used by legislators and universities to create a climate of fear on campus that ignores the rights of the accused.
Samantha Harris, director of policy research at the Philadelphia-based nonprofit Foundation for Individual Rights in Education, said the statistic comes from a 2007 federally funded Campus Sexual Assault Study using broad definitions of sexual violence to inflate the prevalence of the problem.
“Depending on their answers, they were classified as victims, regardless of whether they had identified themselves as victims,” Harris said. “If somebody replied as having sex when drunk then they would be classified as a victim. Sexual assault on campus is a serious issue, but you have to get those numbers right.”

Other critics of SB 967 say the proposed law is too vague and doesn’t represent consensual sexual interaction in the real world.
“To me, this bill turns most people into sexual assaulters,” said Hans Bader, senior attorney for the Washington, D.C.-based nonprofit Competitive Enterprise Institute.'

Is a 'Yes' like a GTC order on the stock market?
OK, stick with me here. It's 4:00 PM. Person A looks at Person B and says "Will you have sex with me?" B answers "Yes".
They part company immediately following the above exchange.
At 10:00 PM, they run into each other somewhere else. Without saying a word, they smile, hold hands, and skip off (yes, literally skip) to someplace private (we'll assume), and do the horizontal mamba (or who knows, maybe they do it standing up, whatever), all without speaking a further word between them. Kinda cute if not perversely weird, but whatever.
Now, has A just "sexually assaulted" B? Was the "Yes" like a Good-Til-Cancelled order on the stock market, in effect until the sex act was, like the purchase of 100 sh. of DOG (i.e., "Dogshit, Inc.") "executed", or does it "time out" after a certain time passes, or if one of the individuals involved has to leave the vicinity briefly for some reason (bathroom break, etc.)? Just what exactly are the "mouseprint" details?
Now, we can't assume A is male and B is female. What if A is female and B is male? Or both A and B are female? Or both are male? What if one is transgendered in some way and the other not? Or both are? Or one's a rabbit and the other's a hamster? And what about threesomes? College kids have been known to have threesomes, esp. these days when they get notoriety for filming it on their cameras and posting it online someplace or something like that (kids these days!!). Or what about group sex of some other kind, 4-somes, weirdly-themed swinging parties on campus, or better yet, bizarre soft-core lesbian porn films made in the library by the local campus feminist undergraduates in such formerly respectable unis as Columbia? (Attention Columbia U administration weasels: I am *NEVER* going to let you live this one down! I will take every chance I get to remind the public of the kind of things you cravenly allow *some* students to get away with because of their gender while persecuting others also because of their gender. You represent exactly the kind of problem that has infected our formerly respectable institutions of higher learning such that they have become nothing more than mediocre islands of ideological extremism presided over by craven and pusillanimous douche-bags like yourselves. You made your bed, now sleep in it. "Ivy League", my ass!)
I mean, seriously. Just what's a college kid who just plain wants to get laid do? Apparently, he (always he, never she) needs to retain a lawyer before going anywhere outside his room. Seems like good advice.
Or better yet, he can go to a men's college and not have to worry about it anymore. As for getting laid while there, well, if he's gay, guess it's not an issue. If straight, well, hard to say. Maybe there's a den of ill repute nearby, or he can see what's what in town on the week-ends. But in any case, at least there, he won't be subject to arbitrary "justice" administered by craven little college administration dorks.
Like the ones running Columbia.
