
Jury's "female discount" standard applies clearly
Well, IMHO, anyway. In fact it looks to me like both parties got off way too lightly. Still, the drunk female driver will likely walk with time served. The male one, probably 10 years. Meanwhile, a perfectly sober law-biding citizen is dead. Justice served here? Not in my opinion. Not by a long shot. Here is the story. Excerpt:
'A Monroe County Court jury on Tuesday held a Penfield man accountable for driving recklessly last summer and causing the death of 40-year-old Heather Boyum.

After 11 hours of deliberation that spanned two days, Scerbo’s verdict was announced before a packed court room of Boyum’s family, friends, lawyers and police officials. The news came about 21 hours after a different jury cleared Scerbo’s ex-girlfriend Megan Merkel of second-degree manslaughter and second-degree vehicular manslaughter, both felonies, in connection with the same fatal crash.

Eric Boyum, Heather’s husband, said he was disappointed by both verdicts. He said he appreciated that jurors found both Scerbo and Merkel guilty of some charges and blamed Scerbo for his wife’s death, but “it just wasn’t enough.”

Scerbo and Merkel, 24, of Ontario, Wayne County, had both faced numerous charges in connection with the July 29 death of Boyum, a mother, wife, triathlete and teacher. Neither had a valid driver’s license.
On Monday night, Merkel was cleared of the felony charges and was released from the Monroe County Jail. A jury convicted her of driving while intoxicated, a misdemeanor, and two traffic infractions.'

"Boyum and a friend were cycling on the shoulder of Route 250 in Penfield on July 29 when Boyum was struck from behind by motorcyclist Scerbo, then struck by a northbound car driven by Merkel, deputies said. Scerbo, Merkel and the two cyclists were all headed north when the crash occurred. Boyum died instantly from her injuries.

Scerbo faces 7 ½ to 15 years in prison for the manslaughter charge, Riley said. Merkel, who has already served nearly 10 months in jail, will likely not be required to serve additional jail time for her misdemeanor conviction."

This happened in NY. But it's no different here than in Canada or anyplace else.

The fact is that too few men appear to have any regard for the fact that they are akin to the jews in Germany.
They take too many chances and rely on others far too much

A war has been declared on men in the last few years,before that there were threats but the legislation
allowed to pass as Justice now has become a nightmare.

I dunno, I think I would need a better understanding of the details before I pass too much judgment.
A witness says that Scerbo, the motorcycle driver (a male) was driving erratic and fast and illegally passed the car Merkell (a female) was driving - I beleive he passed her on the shoulder of the road. While passing Merkell's car he hit the bicyclist which threw the bicyclist under the path of Merkel's oncoming car.
After the accident it was determined that both Scerbo and Merkel were drunk, aside from that it was only Scerbo who was out of his lane and driving recklessly.
I think some people are tying them together because Scerbo and Merkel know each other (boyfriend/girlfriend). But suppose one of us were drinking a few beers at a local pub, then went to drive home, but we were above the legal blood/alcohol limit. (Which is easy to be in the United States since it is set so low), but we were driving just fine. Then at an intersection where a pedestrian is crossing, another vehicle with a drunk driver runs his red light and hits the pedestrian who winds up under our car? Are we then at just as much fault because of our blood alcohol level, even though we were obeying every other driving rule?
It is my understanding that the jury concluded that Merkel was legally drunk, but her driving did not contribute to the fatality. Whereas Scerbo was drunk, but was also driving negligently and recklessly which did cause the fatality(he was driving over the speed limit, out of his lane and illegally passing a car)
