Guilty of rape, doesn't have to register as sex offender

Answer here. You get two guesses as to the sex of the offender. The first guess doesn't count. This was a fairly brutal assault, by the way, with the perpetrator drugging the victim and inserting a foreign object into the victim's rectum while the victim was passed out, causing severe rectal bleeding.

'A 54-year-old Longmont woman accused of drugging and raping a male friend last year could spend up to five years behind bars after pleading guilty this afternoon to menacing and third-degree assault.

Janice McCarl will be sentenced Jan. 22. She faces prison and hefty fines but won’t have to register as a sex offender -- a result that the victim did not agree with, prosecutor Catrina Weigel said.

He "felt she should have to be required to register,” Weigel said.

McCarl’s case was scheduled to go to trial this week, but attorneys agreed to a plea deal at the last minute. If she had been convicted of sexual assault, McCarl could have been sentenced to up to 16 years in prison.'

I cannot imagine a male of any age being able to plea bargain an attack like that down to simple assault to avoid sex offender status. She may have damaged that man life.

I do not understand exactly what she did and why.If he was a friend,as the story goes why did she want to do him harm?What implement did she use if it wasn't a strap on?I could understand the action if there were some revenge motive.Lots of women use strap ons now and lots of guys go along with it but this is obviously different.
The female vagina is fairly equipped to accept larger objects than the male penis
but the rectum is not,ie;this is not rape
alone,this is sodomy,so what reason has the court for allowing such a small sentence?There must be something more or
the Usa law is nuttier than the UK's.

From a news report:

"Janice Lynette McCarl, a 53-year-old Longmont woman, was arrested Wednesday on suspicion of drugging a male friend during a backyard barbecue and then raping him.

"When he woke up, [the victim] remembered Janice had her hands in him... in his Ass," stated the police report.

According to Longmont Police, McCarl was attending a Barbecue at a 50-year-old male friend's house last November when the alleged sexual assault took place.

The victim told police that he became sleepy and passed out shortly after the barbecue. When he awoke a short time later, he remembered McCarl molesting him with her hand "in his ass". He stated that he regained consciousness about 30 minutes later, but couldn't wake himself up fully. He subsequently fell asleep while hearing her say "It's okay, go back to sleep."

The victim went on to tell investigators that when he woke up the next day, McCarl was laying in bed next to him. He also noticed that her shirt had lotion and blood on it. There was also a bottle of lubriderm on the table next to where she had been sleeping.

Days later, the victim began to "put the pieces together" of what had allegedly happened as he slept. When he confronted McCarl, she admitted to drugging and molesting him, but would not admit to what [drug] she used.

Longmont police say McCarl and the alleged victim had a consensual intimate relationship prior to the reported incident.

After a lengthy investigation into the matter, McCarl was arrested and booked into the Boulder County Jail on suspicion of 3rd-degree sexual assault. McCarl appeared before a Boulder County judge on Thursday, who set her bail at $10,000.

Court records indicate that McCarl has two prior arrests that include using fraud to obtain dangerous drugs and possession of dangerous drugs."
