Opinion: #MeToo, Persky and erosion of mercy in criminal justice

'Santa Clara County voters recently recalled Judge Aaron Persky, the judge who sentenced Stanford student Brock Turner to six months in jail to be followed by three years’ probation and lifetime sex offender registration.

As a public defender, I do not see this as a victory for justice. As a feminist, I do not see this as a victory for civil rights.

The #MeToo movement is – perhaps unintentionally – pushing mercy out of the courtroom and replacing it with spite.

By advocating for removal of judges willing to exhibit leniency like Persky but backing behavior of judges like Aquilina , #MeToo advocates support a culture in which judges are more focused on satisfying public appetite for vengeance than carefully crafting an appropriate and fair sentence for each unique case.

Terry Crews Delivers Powerful Testimony Against ‘Toxic Masculinity’

'With most of the media’s eyes trained on the Supreme Court Tuesday morning, actor and former NFL player Terry Crews quietly delivered a powerful condemnation of “toxic masculinity” on Capitol Hill.

Crews, a star of the sitcom Brooklyn 99 who is also known for roles like the Trump-esque President Camacho in Mike Judge’s Idiocracy, appeared before the Senate Judiciary Committee to make the case for legislation known as The Sexual Assault Survivors’ Bill of Rights, as proposed by Rise founder Amanda Nguyen. And he was speaking from personal experience.

“I am an actor, author, former athlete, advocate and a survivor of a sexual assault,” Crews said by way of introduction. After a year in which many powerful abusers in Hollywood were finally held to account and the mostly women who spoke out against them were subject to often vicious backlash, Crews said, “I wanted these survivors to know that I believe them, I supported them and that this happened to me too.”

Cops: Woman Forced Ex To Have Sex At Machete-Point

'A machete-wielding Montana woman broke into her ex-boyfriend’s home, directed him to disrobe, and then forced him to have sex with her, according to police.

As detailed in a criminal complaint, Samantha Mears, 19, entered the victim’s Great Falls residence Friday when he was not home. When the man returned, Mears “confronted him from behind with a machete.” Mears then allegedly told the man to “get on the bed and remove his clothes.”

The victim told police that he complied with Mears “for fear of his safety,” adding that he “did not feel he could leave the room at that time without being hurt by Mears.”  

Investigators charge that after Mears removed her pants, she climbed atop the victim “and they engaged in intercourse.” The victim said that Mears--who was holding the machete--bit him on the arm and “continued to have sex with him after he attempted to end” the encounter.'

John Hemming said their refusal to seek charges against his accuser Esther Baker undermined the criminal justice system and would encourage ‘other fantasists’ to make bogus paedophile claims.

He hit out after Staffordshire Police informed him via email that following a ‘review’ of his allegations, it had decided there was ‘insufficient evidence’ to proceed with the case and no further action would be taken.

The email came more than three years after Mr Hemming first alleged to the force that Miss Baker had perverted the course of justice over her claims of child sex abuse. And it came nine months after the Crown Prosecution Service ruled that there was insufficient evidence to charge him over her paedophile accusations.'

In Sweden, for example, a population-based study that looked at more than two million people from 1975 to 2004 found that only 1 per cent of the population were responsible for 63.2 per cent of all crimes recorded ... That’s a tiny percentage of the population responsible for the vast majority of offending.

The same holds true for sexual assault... The fact is that recidivist offenders are responsible for the vast bulk of all crimes, and unfortunately these individuals are the least likely to be persuaded by rehabilitation campaigns or public education efforts.

“But what about domestic violence?” one may ask...

Uni expands female-only program despite low male enrollment

'Despite ongoing issues with male enrollment, the University of Denver is set to expand its female-only program designed to promote female success.

Founded in 1888, the Colorado Women’s College initially sought to provide educational access to women at a time when they were largely excluded from higher education. By 1982, however, it merged with DU, and by 2016, it ceased granting degrees.

To this day, the CWC continues to operate as an arm of DU, employing five full-time staffers, offering research grants, and hosting events throughout the year dedicated to “the advancement of women and girls.” 

Events from last year included an alumni panel titled “Femme in STEM,” an art exhibit dedicated to “Celebrating Colorado Women and their Extraordinary Stories,” as well as a celebration for female students who graduated in the summer.'

Women-only tech scholarships, ‘Man Tax’ violate California discrimination laws: lawsuit

'A lawyer who specializes in securing equal treatment for both sexes under California law is taking on new territory: women-only scholarships.

Last week Alfred Rava filed suit on behalf of two male students who were barred from applying for a scholarship that is explicitly intended to “introduce women interested in careers in cybersecurity to the financial community.”

The Financial Services Information Sharing and Analysis Center, a member-owned nonprofit that “share[s] timely, relevant and actionable physical and cyber security threat and incident information” among nearly 7,000 members, excludes male applicants from the only scholarship it offers, the two-year-old Building Cybersecurity Diversity scholarship.

American recipients of the $5,000 scholarship also get networking opportunities and an all-expenses-paid trip to the FS-ISAC summit this fall in Chicago, where they can meet top executives in the industry.

Lawsuit accuses uni of anti-male bias in sexual assault case

'A Texas A&M University swimmer filed a lawsuit against the school on Monday, claiming that he was wrongly held responsible and disciplined by a Title IX investigation in 2015.

According to the lawsuit, Austin Van Overdam was found responsible for the alleged sexual assault of female TAMU student Hannah Shaw, whom he met on the social media dating app, Tinder.

During the hearing conducted by the TAMU Student Conduct Office, which heard testimony from both parties but reviewed no other evidence, Shaw claimed that she consented to two of the three sexual acts while Van Overdam maintained that all sexual contact was consensual, according to the lawsuit.

Despite the contradicting testimony, the administrative hearing panel found Van Overdam responsible for one of the four charges, deeming that the first and third sexual acts were consensual while the second was not, consistent with Shaw’s testimony.'

Woman who lied about rape at Michigan college sentenced to jail

'A woman who lied about being raped in a Michigan college parking lot was sentenced to 45 days in jail.

Mary Zolkowski, 21, pleaded guilty to falsely reporting a felony in March. Zolkowski said she told her mother she had been raped in February by a stranger in the parking lot of Delta College southwest of Bay City, Michigan. She said her mother called the campus, and then Zolkowski completed a report.

Delta College police were unable to verify her story, and Zolkowski later admitted it was false.

"I was assaulted previously, not at Delta's campus," Zolkowski said in March, MLive reports. "And because I was ashamed of circumstances of that, when my mother called, I vented through Delta, which was very wrong of me. I should have been truthful from the very beginning, and I used Delta."

Peterson on 'Toxic Masculinity' Training in Kindergarten: 'Appalling' That Schools Are 'Pushing This Nonsense'

'Canadian psychologist Prof. Jordan Peterson shared his views on a University of Wisconsin-Whitewater professor's argument that “toxic masculinity” should be taught to children as early as kindergarten.

Kathleen Elliott argues in an issue of "On The Horizon," an academic journal, that there are "consequences of simplified, toxic forms of masculinity in schools and society."

Campus Reform reported that Elliott wrote that the media promotes “aspects of toxic masculinity such as physical strength, dominance, and heterosexual prowess.”

Peterson said that "you'd have to be a fool" to teach young children such a concept.
