This prospect should be of deep concern to those who care about students’ rights. As head of the office for President Obama, Lhamon’s enforcement of the federal anti-discrimination law Title IX was a disaster out of which students, academia and the federal courts are still digging.

Title IX, the law prohibiting sex discrimination in federally funded education programs (including nearly every college in America, public or private), regulates the way colleges and universities respond to sexual harassment and misconduct. By the time Obama took office, students accused of everything from off-color jokes to rape were routinely denied the very protections that make a tribunal’s decisions credible and unprejudiced. Protections such as the presumption of innocence, the right to face your accuser, the right to see the evidence against you and even an impartial judge or panel were often absent or ignored.'
