Don't Always Believe the Victim, by Wendy McElroy

Article here. Excerpt:
'For ten years, I have argued that both the law and society have embraced a fundamentally wrong approach to accusations of sexual abuse. The approach reverses the presumption of innocence and assumes that an accused is guilty until proven innocent. It also includes giving false accusers a 'free pass'; that is, until recently, it was rare for those who filed false reports to be punished by law.'

Wendy's Truth Has No Political Clout
Ms. McElroy wrote -- "But real victims are not threatened by a demand for evidence."
True.
But feminists ARE.
The degradation of our courts has occured under the political tyranny of radical feminism, funded by VAWA.
And there will be no reform, no repeals of anti-male laws and practices, as long as every Congressperson votes YES for VAWA.
Cut off the tyrant's money, and the tyrant's wither and die.
Feminism is a successful business in Amerika.
It's like trying to repeal Wal-Mart at this point in time.
Not likely....
Wendy's truth re false accusations of DV and rape
"It's [repealing VAWA] like trying to repeal Wal-Mart at this point in time.
Not likely...."--Roy
Yeah, I agree, but I'd much rather repeal VAWA than Wal-Mart.
A great article from Wendy, by the way. Precise, logical and laudable in its fairness and objectivity. I really enjoyed reading it.
And although I know you tend to bang the pessimism drum, Roy, I still believe that criticism of and frustration with VAWA will continue to grow (gradually) to the point where it will be reformed through legislative and/or judicial action. Similar to what's happened with affirmative action policies -- incrementally.
Vengeance vs Freedom
What I find disturbing is the number of people who support the idea that a rape accuser should always be believed. The choice we have before us is this.
1. Every rape case is investigated thoroughly before charges are brought. The idea is that innocent men are not wrongly convicted, even though it might mean that some rapists remain unpunished.
2. Every accuser is believed. This will ensure that every rapist is solidly punished. It will also mean that some innocent men will be wrongly sent to prison (and have the rest of their lives destroyed), but at least there'll be more convictions.
Each of these choices clearly has a price. But there is a worrying number of people who believe that it would be better to punish innocent men in order to secure more convictions. I find it disturbing that the sweet smell of vengeance is worth more than the freedom of the law-abiding member of society.
Can Someone Come Up With The anti-VAWA Soundbite?
My pessimism is based in objectivity and data on the voting records of our elected representatives.
It's gotta be terrifying for any pol to think about casting a "no" vote for THE VIOLENCE AGAINST WOMEN ACT!
The bill's title alone is evidence of feminism's genius for passive-aggressive reverse psychology.
Imagine the headlines --- "Congressman Joe Blow is voting FOR VIOLENCE ON WOMEN!"
Feminism has captured the high ground by defining the language of what is acceptible, and turning all logical arguments against VAWA into "hate speech ...."
You cannot think about what language no longer allows you to express.
Vengeance versus freedom..option number one is how they
All other crimes are treated basically as option number one (except rape, child abuse by a man, and domestic voilence by a man). These crimes, and espicially rape, have been elevated to a very special status..even though that may result in violation of the right to due process (isn't that in the Constitution?).
