On Jury Nullification and Rape
Article here. Excerpt:
'With the possible exception of the sexual molestation of a child, rape is a crime that evokes the most visceral of responses from the average person. And for good reason. Sex that is physically forced or obtained by threat of harm sadistically reduces victims to their most helpless state, and leaves lingering damage that may well last the remainder of a persons life.
It is fitting then, that we seek to justly punish those guilty of the crime, but also that we proceed with caution and diligence, ever observing the rule of law in the process. That rule of law is integral to maintaining order; to preventing justice from being circumvented by political motives or mob rule; to ensure, as should be ensured in a just society, that the rights of the accused are protected with vigor and transparency.
...
And the same people, after reading account after account of innocent men being imprisoned, raped, tortured; destroyed, on lies, will reveal the utter depravity of their indifference by refusing to face what is happening or acknowledge that it even matters.
Their idea of justice is just as corrupt and selfish as the false accuser. They want only punishment, and only where it suits them, at any cost. They care less for the rights of men than Mike Niphong, and their objections should be discarded as quickly as they are raised.'

sexualy depraved
Rape is a despicable act, no doubt.
But why do we only focus on sexual depravites that stereotypicaly come from certain (but few) men. Do we think men aren't vulnerable sexually to women (I know that men can be raped by women). I rarely see it framed in this way but I would argue that lying to someone about not taking birth control pills or poking holes in condoms should be labeled as a sexually depraved act. You could even argue evolutionary parallelisms between rape and stealing someones sperm as both being an amoral way of spreading your genes.
the mans sexuality, both physically and emotionally, has been USED by someone else in a total and annihilating fashion.
Not to minimize rape but what would be worse, someone stealing the use of a woman's vagina once or stealing her eggs for the purpose of creating a child with another person unwillingly. Add to that the way our current system works is that after someone has stolen your fertility you are actually at the very least financialy responsible.
so why don't we attack such acts as vigorously as we already do with rape? Surely we should see how it reduces men to their most helpless state. Do we dismiss his tragedy because life is created? I don't see people reacting to women that way when they become pregnant from rape. Note that men are never a possession and his sperm should never be stolen, no matter what their relation.
We know it is morally wrong to deceive someone in the manner I described before but is there already some manner of legal precedence that could be applied here. Correct me if I'm wring but I think it is illegal to knowingly lie to a partner about having STDs. Similarly one could argue that it should be illegal to lie about birth control. They are clearly both life changing while the deceptive birth hurts the father and children. Also it is already illegal to defile someone's property. Poking a hole in a condom has huge consequences and is very damaging to the victim; therefore the punishment should be serious too.
