Men seek to North Carolina paternity law

'Raleigh, N.C. — Five men who say they're victims of paternity fraud met with some state lawmakers on Thursday.

The men say they have DNA tests proving they're not the biological fathers of children, yet they must still pay child support due to state law, which allows fathers two months after acknowledging paternity to dispute it and one year to prove fraud.

“Anyone in my position that’s got caught in the system, you’re at the mercy of the courts. They’re going to dictate how to live your life,” said Victor McAllister, who says he is the victim of paternity fraud.

“The question is how to remedy that. First to stop any future child support requirements on that person who is not the father; second to do so in a way that doesn't disrupt totally the life of the child,” said Rep. Rick Glazier, D-Cumberland County.

A bill to extend the time period to prove fraud passed in the House last year, but stalled in the Senate.'

1) payments must be stopped
2) all previous payments MUST be paid back
3) the mother in the picture MUST be held accountable - that means punitive fees
4) the STATE must be held accountable - that means punitive fees

In the future ALL pregnancies must be followed by DNA testing to ensure this does not happen again!!

It's very simple, the payments stop, the state picks up the payments to not interrupt the kids life (since they're the ones concerned about it), in a manner that is phased out over 12 or 24 months. The duped-dad gets a court order to have the money paid back. Let her file an extension to pay it back slower, it comes with a 10% penalty plus increased interest.

The woman can assign this debt to the biological father, if she can identify him. The state can get reimbursed by the biological father if it continues the payments, but only once the duped-dad is fully reimbursed.

If the biological dad is identified and there's no reason not to grant him partial custody, he gets extra physical custody time to make up for all the years with his children that were stolen.

That last point is often overlooked, a woman who does this is lying to 3 people, not just 1.
