Seems to me that the government should be the one paying this guy back his money. After all, the government was totally responsible for this fraud even more than this woman perp.
Anyone think this guy will get any part of this judgement back from this woman?

What they do in this state if a "mistake" is made in garnishing your child support (i.e. take it when none is due) is they put it back on you to "go to the mother and try and get it back".
Its classic.
I've even had a supervisor apologize and say that "this is wrong", but "unfortunately there is nothing we can do about it".
What needs to happen in this recent case, is they need to make sure that the guy gets the taxes back that he paid and all his expenses associated with the law suits.

What this guy should have done!
Apparently, the woman wouldn't allow this guy to see his imaginary child. Otherwise, he never would have known that the child didn't exist and then ask social services and the court repeatedly to require the mother to produce the child.
When the court and social services wouldn't cooperate and verify the existence of his child, he should have gone to the police and reported his child missing, kidnapped, or killed.
Ha! ha! Can you imagine this woman trying to prove to the police with all that phony documentation she'd created to prove its existence that she hadn't killed the child???
This guy could have saved himself at least $19k of the $20k he unnecessarily shelled out to this woman, if not all of it.
Worse than that
Trevino isn't receiving ANY punshiment for the fraud..... to Barreras. The $26K he had to pay her that he now has to collect is just a minor mistake in the court's eyes. But the fact that she claimed the child at tax time, a $600 tax credit for 5 years which is a total of $3K, is worth 16 months in jail.
Absolutely shameful.
