The dark side of Title IX sexual-assault investigations

Article here. Excerpt:

'As young adults settle in on college campuses around the country, they'll experience new freedom to make mistakes. While we hope for good choices based on parental example, the fact is that most people learn only from painful experience.

Some will have their first brush with alcohol or drugs. An unlucky few will mix the two and awaken next to someone else in a room full of regret. That's a horrible way to "win" the sexually-transmitted disease lottery or the pregnancy sweepstakes, but worse, it is also an invitation for Title IX of the Education Amendments of 1972 to levy permanent and devastating consequences to their future.

Under Title IX law, there is virtually no need to respect rules of evidence or constitutionally guaranteed rights to a speedy trial, a jury of one's peers, the ability to confront and question witnesses or the provision for a capable defense.

Hello, Title IX; goodbye, Sixth Amendment!

Did You Actually Read the AAU Sexual Assault Survey?

Article here. Excerpt:

'For example, did you know the AAU considers unwanted kissing a crime (sexual battery)?

For example, did you know that persistently asking someone out on a date or for dinner is sexual harassment?

For example, did you know that telling “offensive” jokes is sexual harassment?

For example, did you know that if your partner has ever made a decision for you, you are a victim of intimate partner violence?

For example, did you know that the words “rape” and “assault” were never used in the survey questions—only vague terms like “sexual touching”?'

Case highlights the gray areas of campus sex assault investigations

Article here. Excerpt:

'In March 2014, after a night of partying, two St. Louis University students ended up in bed together at a house off-campus.

Two months later, the man got a letter from the university telling him he was under investigation for sexual assault.

The investigation carried on for months. During the inquiry, it was never disputed that the woman packed an overnight bag, willingly walked to the man’s house, got into his bed and had sex with him.

The pivotal question is whether the man knew the woman was too drunk to consent.

Initially, SLU suspended the student for a year just as he was preparing to graduate.

Two months later, the university reversed itself and cleared him of any blame — but not before holding his education in limbo.'

Huffington Post: Blame 'Hegemonic Masculinity' for Mass Shootings

Article here. Excerpt:

'In the aftermath of the murderous rampages like the recent one in Oregon, some weep for the dead and pray for the wounded. Others, such as the Huffington Post feminist Soraya Chemaly, exploit such barbaric acts of violence to push their own political narratives. As stated in Chemaly’s headline, the real culprit behind mass shootings like the one in Oregon is “Masculinity, Masculinity, Masculinity.”

Despite the fact that Oregon shooter Chris Harper-Mercer has a mixed-race appearance, Chemaly lamented that “another young white man with a gun has wreaked havoc on a community and once again the media is fixated on a numbing conversation about guns and mental illness.” She grants that both these topics are “important dimensions of this crisis,” but claims that

`[w]ithout addressing the gender and race dimensions of male entitlement in the United States -- and the role they play in the treatment of mental illness, gun culture and the targeting of victims -- we will never tackle this problem in a meaningful way.`

From here, Chemaly construed several mass shootings into a homicidal attack on women.

`Schools make up 10 percent of mass shooting sites in the US and are...places where educated women aggregate and compete with men as equals. According to one thorough analysis, women are twice as likely to die in school shootings….Workplace shootings also have a marked result: being killed while at work is the second most likely way for women to die in the workplace, after car accidents….So, it doesn't require an explicit statement of misogyny to result in a explicitly disproportionate harm to women and children due to the violent expression of masculinity.`

Kampus Kangaroo Kourt - The Fiamengo File

Video here. Description:

'Sex is dangerous for male students. An accusation from an angry female ex-partner can lead to the total destruction of his life in the Kangaroo courts set up at every university in North America. The male student has no legal rights and the word of his accuser is often enough "evidence" to find him guilty.

In Episode 9 Professor Fiamengo sends a warning to the boys mothers, many of whom are feminists.'

NPO: Q and A with Dianna Thompson of Women Against Paternity Fraud

Article here. Excerpt:

'WAPF is a non-profit national organization dedicated to educating the public, the media, and policy makers on the issue of paternity fraud and the devastation this issue creates within families and especially for children. While many think that "paternity fraud" is just a men's issue, it is not. Both men and women, boys and girls, can be victims.

Many women are paternity fraud victims, when the truth about who their biological father is was never disclosed to them until years later, or when a medical emergency occurs, or their inheritance rights are being denied. Also, many women -- wives, mothers, grandmothers, sisters, and daughters are also affected by paternity fraud when the men in their lives are victims.

Regardless of whether you are a man or women paternity fraud is devastating. WAPF is composed of women (and men) who have been negatively affected by this issue (or just care about truth and justice) and seek reform.'

Celebrating Brit Shalom Headed to Huge Rabbi Gathering

Article here. Excerpt:

'A 4000-plus convergence of Reform rabbis and congregational leaders is taking place in Orlando this November and Celebrating Brit Shalomwill be on hand.

The Union for Reform Judaism’s 2015 Biennial calls itself the largest Jewish religious gathering in North America. Conference registration is open to the public, with much of the programming geared to those with leadership roles in congregations. Also during the biennial, decisions are made about the policies of the Reform movement.

Metzitsah B’Peh Must Be Banned

Article here. Excerpt:

'One topic I’ve never before addressed on Beyond the Bris is the practice of metzitsah b’peh. There are reasons for this—and I’ll discuss them further down. This very ancient practice takes place during traditional religious circumcision, just after the mohel has removed the foreskin.

Before this practice was in the news because of infants contracting herpes, and long before I was involved in the genital autonomy movement, the way I had always understood the practice—the way it must have been described to me at some point during my childhood (not by my parents)—was as a brief “washing” of the circumcision wound with wine that the mohel (ritual circumciser) took into his mouth.'

Council of Europe doubles down on anti-ritual circumcision stance

Article here. Excerpt:

'The Council of Europe is maintaining its position that non-medical circumcision of boys is a violation of children’s rights, despite reports in Israeli media that said the council reversed its position.

According to statements from Israeli politicians and Jewish activists, the Council of Europe — a body for pan-European dialogue that lacks executive powers  — switched positions when its Parliamentary Assembly passed Resolution 2076 on “Freedom of religion and living together in a democratic society” on Sept. 30.

Milah UK, a leading Jewish advocacy group supporting the practice of circumcision, on Tuesday said in a statement that the resolution “cancels a previous motion that had cast into doubt the legality of religious circumcision.” Milah is the Hebrew name for the ritual circumcision of eight-day-old males.'

UK: Police apologise for not clearing former MP over false rape claim before he died

Article here. Excerpt:

'Met Police has apologised to the widow of Leon Brittan for not telling the former home secretary he had been cleared over a false rape claim before he died.

Deputy Assistant Commissioner Steve Rodhouse wrote a letter to the lawyers of Lady Brittan in which he admits "clarity should have been provided" with regards to the dropping of the allegation against the former Conservative MP.

Brittan died in January from cancer aged 75 unaware that police had concluded there was no case against him over allegations he raped a 19-year-old student at a flat in London in 1967. In a letter, seen by The Times, Rodhouse wrote to Lady Brittan's lawyers, Mishcon de Reya on 7 October saying: "I do recognise that this clarity should have been provided at an earlier stage and I apologise for any distress that this has caused to Lady Brittan".

Poverty Stats: The Fatherless Generation

Article here. Excerpt:

'While the problem of poverty and homelessness is showing it’s [sic] face in more and more obvious ways here in Shasta County, the real impact it has on our community may still be sliding under the radar. It’s not just those on the streets and in the camps that are experiencing homelessness and extreme poverty, but many children inside our classrooms are also in desperate situations. Even more elusive from the scopes is what many are increasingly coming to realize as an underlying cause for increased poverty in the United States: a fatherless epidemic.

Music Video Violence: It’s No Longer Just a Guy Thing

Article here. Excerpt:

'Damsel in distress no longer describes female pop artists in music videos. With the release of the music video ‘Disclosure’ by Magnets featuring Lorde, there is an undeniable gruesome violent trend coming from female singers and it is sweeping across the music video industry.

The 'Disclosure' music video portrays Lorde tying a man, presumed to be a cheating guy, to a chair and then pushing him into a pool as he begs for her to stop. She then opens a lighter and throws it into the pool, setting it ablaze. Sounds like something straight out of a horror film.

American Law Institute Memo: "Revisions to Sexual Assault Provisions of the Model Penal Code"

Memo here. Dated 5/12/2015, it was only recently released after all the signatories had a chance to review and sign it. Excerpt:

'As you are aware, the American Law Institute (ALI) has undertaken a review of the sexual assault provisions of the Model Penal Code. The undersigned members of ALI are concerned about the direction the project has taken. Although the drafts have generated little attention outside of the project itself and although the project has been criticized for late distribution of drafts (see e.g., ALI Reporter, Summer 2014 at 23), we hope that you will consider our concerns both before and during the upcoming Annual Meeting session on Tuesday, May 19 at 9:00 a.m. when Discussion Draft No. 2 dated April 28, 2015 will be considered.
