L.A. judge acknowledges anti-male bias

Reproductive Rights Marc writes "This article at NBC4.TV discusses the paternity fraud case of Taron James, a Gulf War veteran in Torrance, CA, a member of NCFM-LA, and the founder of Veterans Fighting Paternity Fraud. Taron was stationed in the Gulf of Mexico on drug interdiction when a woman falsely identified him as the father of her child in order to collect benefits. The DA obtained a default judgment against Taron using faulty service that wasn't even in Taron's name. When the DA then came after Taron, he got a DNA test that excluded him as the father. The DA still pursued him and took over $45,000 of his property, driving him virtually penniless. When the DA garnished Taron's unemployment pay, Taron appealed it. The administrative law judge wrote a decision saying that he cannot do anything about it but that this was totally unjust. The article quotes part of the decision, but the best part, not quoted in the article, is when the judge says: “Further, it is acknowledged that ongoing fraud in the child support arena occurs regularly, and there is a distinct anti-male prejudice at work, of which the claimant is a victim. Hundreds if not thousands of individuals are being deprived of their due process rights to liberty and property as a result of draconian child support laws.” When NCFM-LA gets its website finally updated, we'll post the full decision."

Would it be possible for a man who is screwed by the system and judged responsible for child support for a child he can prove through DNA is not his, turn around and force the mother to provide the real father's name so that he can sue the mother and real father for reimbursement of all fraudulent support and expenses incurred?

This is not a hypothetical example. The famous case is of Carnell Smith, who is on a personal crusade to fix this state by state. He got screwed by Georgia and the US Supreme Court. Yes, the father was even identified, but he was still required to pay child support because he (get this) had established himself as father by paying child support. Best interest of the child etc. came into play too.

Carnell Smith's Paternity Fraud website isn't commercially slick, but has a inspiring personal feel. He is one strong man making a difference, and we should all be grateful to him.

My guess is that Mr. Smith has chosen to devote time and resources fighting paternity fraud in the courts and legislatures, rather than on the internet. Slick websites cost a lot and I seriously doubt he is flush with money, given all he has been through. Unfortunately, information on paternity fraud is hard to come by on the internet. I have yet to see one slick website on the subject. The paternity fraud movement needs to consolidate its resources and manpower into a single organization. And we need to recruit Rush Limbaugh, Michael Savage, and Bill O'Reilly to our cause.

Thank you for your service to your country in the Gulf War and in your drug interdiction efforts. You have suffered a gross injustice, simply because you are male. I hope that one day you and other men won't be treated so terribly badly.

I congratulate this judge for having integrity, but why is he the exception? Why is it so rare to find a judge with integrity among judges?

I've always said that judges are "pimps of justice" and that justice itself is the "whore," but I see where you could make a very valid arguement as you have stated, "that the judges are the truest whores."

I am going to digress just a little in order to suggest a potentially very powerful counter strategy. First, let me say I am Canadian so there are variences in legal procedures between the US and Canada but what I am going to suggest would work in either jurisdiction because this strategy HAS worked in the past to force the issue of striking down Draconic laws....Ok to begin...the arguement that capital punishment deters murder is pure BS...FACT capital punishment failed to deter the theft of livestock. What got capital punishment struck down as a penalty for the theft of livestock was NEVER the conscience of politicians or judges...they were far too concerned with offending the wealthy and politically well connected cattle barons to afford themselves the luxury of a conscience. What DID change these draconic laws was the strategy of ALWAYS demanding a jury trial (rather than trial by judge) and ALWAYS using every step of appeal available. After a while it became impossible to find twelve people willing to kill someone because they stole a horse or a cow and the process costs became greater than the losses from rustling.

Once again we are being beaten because we are not willing to fight dirty!!! Everyone who goes to court has this naieve notion that justice will be done and if he behaves himself and does not upset the authority figures his losses will be most minimal...WRONG!!!! Plea bargains are about the cost/benefit of the prosecution procedure!!!!! MAKE YOURSELF THE BIGGEST AND MOST PROCEDURALLY EXPENSIVE PAIN IN THE A** THAT YOU POSSIBLY CAN BECAUSE YOU HAVE NOTHING TO LOOSE BY DOING SO!!!! If enough men do this the whole thing will get re examined purely as a cost/benefit consideration.

And can I ask a dumb question? WHY IN THE HELL HAVE WE NOT MADE THIS A PET PROJECT OF THE ACLU??? If even a small number of these cases made it to the Supreme Court as constitutional issues these laws would get struck down.

The more we fight in court, the more money lawyers make. And the broker we become when they totally screw us regardless of the circumstance.

I think our solution is in the legislature and voting out the bastards who create the male-bashing, no-win laws against men. We've got to create laws that take the discretion away from stupid judges.

Only after a string of representatives are thrown out because of their voting records will things begin to change.

I tried to get on the Michael Savage show to talk about paternity fraud but was consistently blocked by the screener. We need to FLOOD his show with calls and e-mails from thousands of paternity fraud victims day in and day out until he has NO CHOICE but to start listening to us. With Savage, Limbaugh and others on our side, we will begin to make progress. As long as the public is ignorant, we are screwed.

We need to flood the emails of folks like Limbaugh, O'Riley and others.
If we make it so they CAN'T ignore us I think guys like that will get on board.
Since the feminists use the left for their agendas, why not use the right for ours?

...We also need to try and get through to FOX NEWS. It is said that they are "biased to the right" but I think they just aren't afraid to report things that are "politicaly incorrect" (like male victims of DV)
We could make great strides, I'll bet, with them reporting our causes.
Since the "main-stream" media sits on and\or ignores men's issues (and only reports WOMEN'S issues) FOX could be OUR sounding board.

Taron James just appeared on Tom Lykis's radio show in Los Angeles talking about Paternity Fraud, and mentioned the National Coalition of Free Men.

I'm sure thousands and thousands of people heard this show as 4 to 5 is rush hour and Tom Lykis is very popular.

I am so proud of Taron. I'm in the military and wrote him a quick E-mail when his story first came out. He's a tenacious man and I am so proud of him working to help victims of paternity fraud.
