News This is the kind of thing you'd expect to come from The Onion, except in this case its real. From the article...

"Sex between kids is not legal," said Assistant District Attorney Lori Kornblum, who is prosecuting the case. According to the law, "Whoever has sexual contact or sexual intercourse with a person who has not attained the age of 16 is guilty of a Class C felony." There is no mention of consent.

One is a second degree, and one fourth? What is the difference? Why the difference? I don't blame the attorney prosecuting, because obviously these kids needed some help in their family situations. Why are charges not being brought to their parents? Is there a 'bad parenting' charge yet? Like a misdemeanor?

Well, because the second degree is on the male, who is always the victimizer, andd the 4th degree is on the female, who is always the victim.

That is the easy answer that takes no thought, and even less evidence. I was wondering about the serious answer, the one the lawyers justify.

That is the serious answer. You will consistantly find lighter sentences women for the same crime, and lesser charges for the same action. Try and find, outside of this Board and its cousins, a random set of a dozen people who will affirm that a woman can rape a man.

Yours is the easy dismissal that takes no thought, and pleads at semantics. Look at the big picture and see what it demonstrates.

It's possible that the girl pleaded to the lesser charge to get it over with.

Not sure if she was in custody or not. Sounds like they both have criminal records already and it's being used agaisnt them.

Sounds like the boy might be tuffing it out and not willing to plead. If thats true, god bless him.

I'd like to see the Supreme Court's descision on this. It will seriously affect wether or not I buy a gun.

Well it did say she was naked and made no reference to his state of attire. If he was dressed wouldn't that be greater evidence of sexual intent on her part?

What can I say? This is just ludicrous.
Why do parents want to prosecute their own kids? Why should taxpayers be paying to prosecute kids the same age for having (or considering having) consensual sex?

This is just weird. And it makes a mockery of the Statuatory Rape laws, the intent of which is to prosecute ADULTS who sexually exploit minors or children.

How can two people rape each other, statuatory or otherwise? The mind boggles.

1. Why is the 14 year old boy being held under more serious charges than the 14 year old girl? Does this imply the state believes that males even as young as 14 are more mentally mature and therefore more responsible than a female of the same age?

2. What is society going to do with all the millions of little boys and little girls between the ages of 4 and 10 years old who play "doctor's office" and "show me yours and I will show you mine?" Arrest them and prosecute them with molestation when they reach age 21? Of course the males will be prosecuted under more extreme penalties since they are so much more responsible than females.

3. And just where do these ding bat prosecutors get off saying they are prosecuting these 14 year olds to help them not hurt them? This is just "NUTS" and we taxpayers are paying for this shit?
