Court Rules She Who SLAPPs First Wins

Domestic Violence Subversive writes "After the relationship between Sean Fabre and his girlfriend, Amalia Walton, soured and Walton placed a restraining order against Fabre, he countersued her for 'abuse of process,' claiming that she filed it for vengeance, not for protection. On Friday the Massachusetts Supreme Court ruled that under existing anti-SLAPP laws, alleged abusers who are the subjects of restraining orders should not be able to 'easily retaliate' with civil lawsuits against their accusers. Alleged abuse victims will now be able to quickly end any civil litigation filed by the target of a restraining order unless that person could prove there is a 'substantial basis' that the restraining order was 'devoid of any reasonable factual support.' This suggests to me that battered men in Massachusetts who have also been falsely accused of domestic violence may have to look to other means than the legal system in order to protect themselves--what a terrible decision!

Hey Nightmist, remember that question you asked in the Jamie Nelson thread concerning whether it is better for a man to use civil means against a false accuser. Well, I think your question has just been answered -- at least with regard to one state.

I sometimes wonder why we even get married. Whats the point if the woman can say whatever she wants and is always believed. This type of ideology is what creates violence. Then again maybe thats what they want (feminists) so they can say "see I told you so, men are scum". If we do not have a way to address our concerns in court 'civil war' will be the only answer. The lies and the constant belief of lies has thrown the system into 'dispute'. That constant unfairness is what creates violence. Thats the same as bill 117 in ontario. If they are wondering why so many women were murdered by their ex's one not need look furthur than the "Allegation Invitation Laws" feminists work night and day on to create. Fair laws = civil society. But unfortuantly these women will have to take responsibility for their lives and act like adults. Imagine that a "grow up and act like a woman" mentality. For anyone interested what an Independant Woman is go to http://www.iwf.org/ look up Christine Stolba and her associates. They are attractive and well educated women who will one day destroy the 'glass ceiling'and teach women how to gain and hold power and command respect.

This is a great way to further P.O. men and push them to taking the situation into their own hands. When the courts refuse to consider that women lie in a great number of Domestic Violence cases, what other chioce do men have?

The Feminized courts are the most ruthlessly biased.

So has the system spoken. Shut up. Suck it up. Take it like a man. It's no more than what you deserve.

I would have never known anything about "men's activism" had I not had a vindictive girlfriend who used a bogus restraining order with false abuse charges in it to keep me out of her life and to bilk me out of a lot of money.

I suppose men could use the "system" too, but the court magistrate and the whole system seemed stacked against me as a man. I never was even allowed to state me case. Just "shut up" abuser or pay more penalties was the message I got.

Like all men, I "sucked it up" and left with my tail between my legs, having done nothing wrong.
Now I have a bogus retraining order on my record, and had the police show up at my condo to serve me papers, missed work, and am generally bitter and in shock about the whole process of prosecuting someone before the facts, and without evidence of abuse and without close examination.

I imagine it will only get worse (like Canada) if men don't standing up to the feminist haters that have violated due process. The system right now is really bad, and most men don't even realize it because most men are not "batterers" and think it could never happen to them, only to bad people. I tell you, this simply isn't the case.
