Georgia Passes Paternity Fraud Bill

Reproductive Rights In an incredible victory, Georgia's Senate passed a bill giving men recourse in the event of paternity fraud. This means that when a divorced man takes a DNA test and is proven not to be the father of a child, he is not obligated to pay child support for that child. This common sense law was a long and difficult struggle, but in the end, the efforts paid off. For example, in the GA Senate, the bill passed with a 90% vote in favor of it. You can read a press release about the victory on PaternityFraud.com.

Now for a refund of any child support he paid before the deception was discovered (with punitive interest, of course).

Absolutely agreed, sd. This was just the first step, there's more that needs to be done.

So Georgia has finally conceeded that proof of innocence is enough to stop further actions taken against a male.

Amazing that this battle had to be fought, let alone how much of a stuggle it was. Well done and thanks to all those who contributed to the passage of this bill.

Wonder how many other states have bills like this pending. And how many legislatures will reconsider this issue in light of the Georgia bill. And how much of a ruckus the GenFems are gonna raise.....

Wonderful news - hope it's catching.

Okay, but what if the woman has no assets? You can put her in jail, but the guy's still out his money. Sometimes the guy will be able to get the money back, but sometimes it won't be possible. This is true in every fraud case.

And yet fraud is still illegal, (except when a woman does it). Even if the man can't get his money back, she still should be punished for her crime.

Agreed, but the kid should be able to sue her too. After the mother's in jail, the kid will be thrown into the foster system unless another relative is willing to take it in. The kid's life will be destroyed and the mother should be held responsible for destroying it, even if only on paper.

If the mother does have assets to seize and auction, the money should be split between the guy and the kid. The kid suffers just as much, especially if it ends up in the foster system. It's just a shame that, in most cases, there won't be very much to seize and auction, if anything. We can throw the mother in jail and throw away the key, but the injured parties are out their money.

Let's be frank about this.
Thankfully, this bill remedies an outrage against a very small number of men.

The only way I see this bill as being a major move to affirm men's rights is if it can be used as a stepping stone to get more pro male legislation that affect larger numbers of men in the state.

Now that the men's movement has at least gotten the attention of the Georgia legislature (a misandry loving bunch if there ever was one!) it would be very nice to reform child custody and support laws and the formula for dividing up the marital assets. More legislative and judicial support for prenuptial agreements is essential.
More protection for men from false accusations of child and domestic abuse.

Yes, if this small victory can open the door to true reform then it will serve a higher purpose.

It's funny you mention that, Luek...I have another post queued up to appear today which announces a child support reform bill which was recently introduced to the GA House. Keep an eye out for it later today.

Also somewhat related to this is that in New Hampshire, the Senate Internal Affairs Committee is holding a public hearing on a bill which would establish a Commission on the Status of Men in NH. The bill passed in the House by a significant margin, but the Senate is going to be a much tougher struggle. I'm heading to Concord this afternoon to testify on the bill. IMHO we have about a 30% chance of success with it, and I'll have a better idea of this after today.

Way to go Scott! I applaud your activism!

Hope there is a better than 30% chance of getting that progressive egislation passed by the NH Senate.
If not this year, then the next.

Good luck.
