RCan't say I think the boys case is being handled unfairly.
Of course "zero tolerance" policies idiotic, and seem to go against human nature. I've heard stories about students being denied the opportunity to graduate because household utensils or unloaded guns have been found in the back seats or floors of their cars.
If the boy hadn't been so young, I don't think they would have hesitated to throw the book at him. No matter how innocent his intent.

There was a girl suspended from school for having a chain wallet - a thin little plastic chain and the wallet was Tweety bird. It's getting absurd. I am getting pretty diligent about checking my daughter's backpack before she leaves the house for anything that can be used against her - Harry Potter cards, ballpoint pens, throat lozenges. Seems they'll suspend a kid for anythign these days.

Yeah, pretty soon they won't be able to sharpen pencils anymore.

An 8-year-old boy saved his teacher's life with the Heimlich maneuver, which he learned merely from having read about it in his mother's day-planner (and he said he was prepared to do a tracheotomy with a PEN KNIFE if that hadn't worked) (Issaquah, Wash.). A large part of the problem is the sue happy society we live in. Schools have little enough money for education and live in constant fear of some parent getting upset and sueing them.
My personal feeling is zero-tolerance are just idiotic especially when imposed on children.
I am very tempted to home school my daughter when she is old enough to start school. not because I am afraid of something happening to her but because the absolute stupidity of some policies. (i'll probably send her and the first BS issue that comes up pull her out and educate her at home.) Tony H
