Woman alleges she was raped over the phone

Yes indeed, folks, we have a classic example here of a man using his Magic Patriarchal Phallus-Power to rape a woman over a telephone. He used some kind of evil dark mystical power, possibly in collusion with Satan himself, to commit this dastardly deed. Story here. Excerpt:

'TUNIS, Tunisia, April 27 (UPI) -- A Tunisian family alleges their daughter was raped during a telephone conversation with a man, a lawyer for the family said.
...
"The intercourse did take place with all its details but verbally only," he said. "The sexual act did not really happen because the physical proximity factor is not there, yet it happened because there is a direct physical impact – the loss of virginity."'

The girl lost her virginity at some point in the recent past, and realized that when she goes to get married, she will probably be examined by a doctor to verify the intactness of her hymen, as per the uptight and ridiculously conservative traditions still found in some parts of the world.

So how would she explain to her ultra-conservative parents how it happened that she could lose her hymen without actually having had sex? The answer is simple: since they don't let her get out on week-ends and probably keep an eye on her more harshly than the typical "helicopter parents" of America (hell maybe in the 5 mins. they took their eyes off last week-end, she diddled the lawn-boy, who the frack knows??), she couldn't say she went to a friend's house and was raped along the way by someone in a small '78 Pinto. So instead she says she was raped over the phone.

Yes, that's the ticket. And she needed to name names. So she is accusing some guy, whoever he is, of somehow raping her by voice, causing her hymen to break, and thereby explain the loss of her virginity.

It was magic. Magickal, mystical, Satanic powers at work. That's the answer. Uh-huh.

So, she didled herself while talking to this guy on the phone, and her parents want some monetary compensation for their daughters loss of her hyman, less marketable now? I wonder what the courts over there are going to do about this one?

I find it very interesting that more and more of our societal definitions of "violence" are symbolic and virtual.

There was a piece not long ago about criminalizing "staring at women" in the U.K.

You can already be prosecuted for cyber-stalking for sending two or more "unwanted" e-mails.

So, the social definition of "violence" no longer requires physical aggression or even actual proximity. In essence, you can "violate" a person you have never seen or met.

Interesting?

The law is ever more intruding into private
relationships and interactions, thereby criminalizing the personal sphere of life and denying people any actual privacy.

We are in fact moving towards Brave New World where even your thoughts and fantasies can be crimes.

I'll admit I don't know much about Muslim stigma regarding consensual premarital sex, female masturbation, and rape. However, based on what little I do know, and the phrasing of the article itself, David's interpretation makes the most sense to me.

This is definitely an injustice, and I hope that this absurd charge against the guy is dropped. However, it's important to understand the cultural context before we lay the blame entirely on the woman. In cases like this, the blame may lie more on the family or the culture itself, and less on the woman involved.

It's good to remember that the enemy is not always a woman, as Roy pointed out. If we as MRAs only aim our attacks at women, we're ignoring a large part of the problem--and we're setting ourselves up to fail.

MJE,

I am not by any means letting women off the hook.

But I try to think about the social systems and environments that condition and control gender relations.

A woman who proposes she was "raped" over the phone is really interesting!

She was not touched by the man on the other end of the line.

But somehow he "violated" her with words alone.

That is the Evil Patriarchy in action!

Was she at all responsible for listening?

And, of course -- the basic question is --

WHY DIDN'T SHE JUST HANG UP THE PHONE?

Roy:

I should certainly hope you wouldn't let women off the hook. That would be as damaging to the men's rights movement as laying all of the blame solely on women, disregarding cultural and societal contexts.

My comment was based off the article's wording. "A Tunisian family alleges their daughter was raped," not "A Tunisian woman alleges she was raped." From that phrase, I'm making the assumption that it is the parents--not the woman herself--who is making the accusation.

(Which would answer the question of why she didn't just hang up: it was entirely consensual, and she isn't the one accusing him.)

But really, with such a short article, and without knowing much about Tunisian/Muslim culture, it's impossible to get a firm grasp of the situation.

Hopefully, if this does go to court, the judge will realize how ludicrous this accusation is.

Leave it to an Indian mystic lawyer to make this statement:

"the physical proximity factor is not there, yet it happened because there is a direct physical impact"

Only someone with a mystic philosophy, coupled with a legal mind, could make such a statement and hope it to appear valid. If they're all of that school in India, I guess the guy is doomed. Maybe he can go to prison "by correspondence" - he will not be confined due to not being physically proximate to the prison, but will nevertheless suffer the physical impact of being confined in the prison.

So it's not India, not Hindu or Buddhist. But doesn't Islam contains elements of Eastern mysticism? It sure sounds to me like it does.

As far as the correspondence sentence, I guess the guy could stay inside his house, and self-administer beatings and a starvation diet.
