Woman Stabs Estranged Husband to Death, Faces Two Assault Charges

Manslaughter? Even unintentional homicide? No. "Assault". Story here. Excerpt:

'November 9, 2007 2:20 pm — An apparent domestic dispute led to a man being fatally stabbed about 9:45 p.m. last night at 42 Wilcox St., just off Monroe Avenue, in the city.

Roman Demary, 28, of Rochester, was transported to Strong Memorial Hospital with life-threatening injuries. He underwent surgery, but died about five hours later, police said.

Denise Ortiz-Demary, 25, of Rochester, the victim's estranged wife, was charged today with two counts of first-degree assault, according to Public Information Officer Deidre Taccone.'

Depending on what degree of assault, she is facing either a Class B or D felony, or a class A misdemeanor. Possible time then is this: 5-25 years, 2-7 years, or up to 1 year. Suppose she'll go to trial? Or be found guilty? If so, how much time (if any) will she get?

Assault...for a death? That doesn't fit at all.

If the DA thought that this may be a case of self defense, then he/she wouldn't even charge her, right? So this isn't a "self defense" thing. I think that (of course, I'm no lawyer) Manslaughter 1 would be a stretch, too...can you claim "crime of passion" for an argument turned violent?

Assault doesn't cover death. But if they think that her intent was Assault 1, and the victim died as a result of it, wouldn't that constitute felony murder (death arising from the commission of another violent felony, regardless of intent)?

Something stinks with this one. Big time.

i wonder what history will call these times where women are allowed to murder every other group on earth, the "unborn", the "being born", and "men" and get away with it all. SOP.

...the murders will continue. Remember respect -- when it comes to gender -- must be fought for when it comes to women. This must be done -- by men -- via laying down the law on women's childish asses and exposing men that pander to women as punks and sissies.
