Baby-wielding mothers seeks withdrawal of guilty plea

"ERIE, Pennsylvania — A mother who admitted swinging her 4-week-old son like a bat to hit her boyfriend, fracturing the infant's skull, wants to withdrew her guilty plea.

Chytoria Graham, 27, of Erie, asked to withdraw her plea Friday — the day she was to be sentenced to at least five years in prison.

Under an agreement with prosecutors, Graham had pleaded guilty in March to aggravated assault and endangering the welfare of a child; reckless endangerment and simple assault charges were dropped.

Graham now says she was not responsible for the injuries to Jarron Troop, who has since recovered."

According to her and her lawyers:

"Graham pleaded guilty because she had been drinking that night, and as a caring mother, felt she was responsible for whatever had happened to the child, said defense attorney Julia Dudics.

Another defense lawyer, James Pitonyak, said Graham has since recalled events more clearly and now believes that her boyfriend, Deangelo Troop, Jarron's father, also caused the baby's injuries."

So this violent alcoholic of a "caring mother" sobered up just long enough to realize that her lawyers had worked out a deal for her that would essentially allow them to wash their hands of her and dump he in prison and said 'hell no!'

Her counter argument that excuses her behavior seems to be two fold,

1. The infant got better so no harm done (I wonder if any rapist has ever tried that excuse saying the physical injuries to their victim healed)

2. My boyfriend was the one who I hit the baby with and it was the impact with is body that caused the injuries to the baby so really it's his fault. (sort of a variation on the old saying about suicide from leaping from a building that "It's not the fall that kills you. It's the sudden stop.")

That's pretty much it right?

That's perhaps the most fucked up defense I've ever heard any an accused criminal attempt to play.

The only thing I can think of to say to that is:

"Ladies and gentlemen of the supposed jury, I have one final thing I want you to consider: (pulling down a diagram of Chewie) this is Chewbacca. Chewbacca is a Wookiee from the planet Kashyyyk, but Chewbacca lives on the planet Endor. Now, think about that. That does not make sense! (jury looks shocked)

Why would a Wookiee -- an eight foot tall Wookiee -- want to live on Endor with a bunch of two foot tall Ewoks? That does not make sense!

But more importantly, you have to ask yourself: what does that have to do with this case? (calmly) Nothing. Ladies and gentlemen, it has nothing to do with this case! It does not make sense!

Look at me, I'm a lawyer defending a major record company, and I'm talkin' about Chewbacca. Does that make sense? Ladies and gentlemen, I am not making any sense. None of this makes sense.

And so you have to remember, when you're in that jury room deliberating and conjugating the Emancipation Proclamation... does it make sense? No! Ladies and gentlemen of this supposed jury, it does not make sense.

If Chewbacca lives on Endor, you must acquit! The defense rests. "

I forgot to put the words "now late" to it. I can cast a dark magic spell, but... (lol) Yeah, ZOmbified Cochran would be a little intimidating in court.
Shapiro would work too... does he know the chewbacca defense? Or does he use a similar yet different defense?
