Man Ordered To Pay Child Support Despite Not Being Father

'A man in Oklahoma is hoping to change the law after he has to continue to pay child support for a baby that is not his, according to our affiliate KOTV.

When Thomas’ high school girlfriend got pregnant, he married her. Five months later she had a little boy and he believed he had a son, but their marriage fell apart.

Thomas decided to take a paternity test when the boy was three years old.

“It comes back zero percent. I was in my office and I saw that. I should’ve expected it but I didn’t and it hit me. I’m telling my co-worker how shocked I am that someone could do this to someone,” he said.

The judge ordered Thomas to take another DNA test and he got the same result. The judge first ruled that Thomas was off the hook financially, but then reversed the decision because Oklahoma law says men must question paternity within two years of the child’s birth.

Thomas said that he had no reason to question it before he did, but, because he missed the deadline, the judge ordered him to pay around $500 a month in child support and nearly $15,000 in back support – for a child that is not his.'

Women had the same time frame for establishing paternity.

If a woman doesn't establish paternity within two years, then she would be stuck supporting the child herself. But we all know no such limits apply. A woman can come back years later and establish paternity, often resulting in instant dead-beat dad status for the man. In this case, the man owes $15,000 instantly.

But no, even though that would be fairer, if the man's not the father, he's not the father, and should not be forced to pay. The best solution is DNA testing at birth for all newborns to determine paternity. The man typically doesn't know if he's the father or not. Only the mother knows who she slept with--and if she fails to identify all possible fathers, she is committing an act of fraud, which is unfair to the child and the father. But we all know the system is not about truth or fairness or justice--it's about money.

based on the % of single men who wind up not being the baby's daddy after a d.n.a. test, there are (tens of) millions of men in the u.s. required to pay c.s. for a child that is not theirs. why is this instance any diff? imagine what those numbers were before the breakthroughs in d.n.a. testing. combine that w/ the number of men falsely accused of sexual offenses and you can see whose side society and their crooked lawyers/judges has taken. is it any wonder marriage is on the rocks?

good advice to anyone: NEVER sign a one sided contract (i.e. marriage contract). and don't be fooled by a pre-nup. the judge can and will declare it null and void if ANYTHING changes w/in the marriage (i.e. children), or if he feels the woman isn't getting enough, or the sun didn't come out today, or his breakfast didn't sit too well, or ...
