What Constitutes Rape?

A 17-year-old male has been convicted of forcible rape in California. What was his offense? A 17-year-old female was engaging in consensual sex with him. He allegedly continued to have sex for a minute and a half after she said, "I should be going now" and "I need to go home." Note that, by all accounts, she never said that she wanted to stop having sex.

If he had said, "I should be going now" and "I need to go home," and they then continued to have sex, would she have been convicted of rape?

Also note the article's statements "In California, for example, the Legislature and the state's courts have been revising the definition of rape," and "Among other changes, women sometimes were required to physically resist to be a rape victim, or their allegations had to be corroborated."
