Woman sues over ongoing sanctions for sex as a teen

Story here. Excerpt:

'At age 17, while a high school sophomore, Whitaker had oral sex with a 15-year-old male classmate. In 1997, she pleaded guilty to sodomy and got five years' probation.

Whitaker, 28, has moved twice because of the sex offender law's restrictions that say an offender cannot live within 1,000 feet of places where children congregate. Whitaker was recently told by a sheriff she must move again because her home is within 1,000 feet of a church.

Last week, Columbia County Sheriff Clay Whittle, after finding Whitaker's name was placed on the deed in 2007, ordered her to move within 48 hours.

"Wendy Whitaker is not now and has never been a threat to anyone," she said. "The state of Georgia has better things to do than to evict a woman from her lawfully purchased home because she had sex as a teenager."

As for Whitaker's case, Hudson added, "My personal opinion is it seems to be costing the state of Georgia a lot of time and effort because of a law that reaches out to place these onerous burdens on offenders who are not predators.'

Awwwwwwwwwwwwwwwwwww ...the sex offender... errrrrrr... the girl doesn't want to have to move again...

Maybe with it being a female plaintiff/registered offender, someone will look at the law and say "Hey, the registered offender is a woman and she's not a predator... we can cut her a break here?" and it will slide sideways into the 'Female Sex Offender Discount' category.

I liked the part about the Sheriff is willing to wait until it's heard in court (do you suppose they'd give a guy the same break?) to enforce the law.

No person of either sex should be getting this kind of shafting. But Gunner Retired makes a very good point-- seems the wisdom of such laws are only questioned when the party being whacked around by them is female. Indeed, if this were a man who at 17 had oral sex with a 15-YO girl, there'd be no story.

Actually, this is great news. I recognize GR's desire to underscore of the double standard, but this looks like just the sort of lawsuit that is needed to call into question the exercise in paranoia that whole "sex predator" industry has created. We need more of these lawsuits - not less. And if it just so happens that only women have the balls to stand up for what's right through use of lawsuits, at least men will benefit once the precedent is set. Lord knows part of our problem as men is we refuse to make the noise that women make when they feel wronged.

So I wish her all the luck in the world! This is something we need to be getting behind - not scorning.

Mcc99, any man can bring a lawsuit against a city as well as any woman. The difference is women seem to be more likely to use the government (ie: courts) to check the government. We could learn a lot from women like this as we need to start doing the same.

That she was permitted (oh how gracious Mistuh Sheriff) to remain in her residence aside, let's look at some comparables:
Wendy Wihitaker was 17 and engaged in oral sex with a 15 yr old boy... 5 years probation.
Genarlow Wilson was 17 and engaged in (as in received) oral sex with a 15 yr old girl... 10 yrs in da pokey (based on mandatory sentencing guidelines).
THEY BOTH WERE IN THE ALANTA HUB REGION (same 'burgh the Barbie bandits got out of bank robbery charges with a slap on the wrist) where F.O.S.D. (Female Offender Sentencing Discount) in the order of the day!!!
But sentencing aside, do you for ONE MOMENT suppose Genarlow would have been granted anyones blessing to remain in the home past sunset? Much less until the suit was heard in court?
Hahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahahaha...
Oh I soooooooooooooooooooooo don't see that happening.

People don't seem to care about this type of thing happening to a male b/c a lot of us guys don't take the time to speak out against the injustices faced by our gender. I suppose a lot of us are used to it. It's good that these stupid laws are affecting women too, because women seem to make a lot of noise when they're wronged by something like this, and people will actually listen. It is a double standard, indeed, but in this case, it will help our cause. A story like this will also make people think about how unfair laws like this are to both genders.
