My first reaction was horror, but on reading the article it seems more a case of who's telling the truth.

For a start, he had the choice of destroying the sperm, or cancelling the freezer contract (or whatever) to ensure it was thrown away - but instead he chose simply to stop paying the bill, leaving the sperm available to his wife - not that this in any way condones what happens next, but not a smart choice.

If the wife is right and he did cash continuing refund checks for continuing fertility treatment, then he must have been aware that she was continuing to try to get pregnant. He must have had some idea that she might be trying to use his sperm. And if those consent forms truly were signed by him, then he's pretty much stuffed because he gave his permission for the sperm to be used.

On the other hand if she's lying and he didn't know she was still trying, and didn't sign any forms, then this is a sick and bizarre case and the poor sod's going to get crucified unfairly.

they are still married. she was apparently a part of the agreement. he changed his mind. she did not. he did not even try to prevent it other than stop making the payments. she continued the investment as it apparently was her choice. at this point..it's theirs not his.

if they were divorced i think it would morally be different. he was no longer having any sort of relationship other than regret... it's not the same as trusting a woman when she say's she had her tubes tied either... that pregnecy occured during an equally willing relationship, no matter how short it was....

lol... i can see all sorts of scenario's... like what if he was drunk and she sorta helped herself while he was out of it. and he would have never touched her in his right mind... but he was having a real good dream or something.... would he still have to pay child support? if a man did that to a woman... he would have to pay child support but only after he got out of jail for rape, right? the guy is gonna pay no matter what! the moral of the story here is don't leave your stuff in the hands of third parties and also dont get too drunk around the less than desirables. ... ummm that's enough brain waisted on this topic..
