Mass. Gov. Swift Denies Freedom For Innocent Man

News ronn sent in this column from the Washington Times, which relates the story of Gerald Amirault, a man who, along with his sister and mother, was convicted on fraudulent child abuse charges 16 years ago. In spite of the unanimous recommendation of the Governor's Board of Pardons to free Amirault, Mass. Gov. Jane Swift has chosen not to do so, apparently for fear of election backlash. The column's author suggests that Swift's re-election campaign is more important to her than justice.

The last few stories here have been about the United States. The stories are very similar to the ones that prompted a person from this site to call Canada the worst place in the world to be a man. I guess this just goes to show you that it isn't the case after all and that Canada isn't so bad.

The issue that defines Canada as uniquely hostile to men is false accusations and property rights. Canada is in the process of creating legislation to further eliminate all rights to due process on a simple accusation. Upon such an accusation, there will be a loss of property because it is transferred to the accuser. Gee. Ya think that practice might motivate people to make false accusations?

So yes, that practice will indeed define Canada as one of the most hostile places in the world for men. And yes, CA is in lockstep with CA. It is becoming more like the Taliban every day.

I wanted to add that it is Ontario that is planing to have these laws, not Canada.

Secondly, maybe Ontario has that perticular man-hating law, but it is far from the only place in the world to have man-hating laws, like that or worse.

I gave Scott this information last week, there is a site by Jonathan G. Harris. He is a prof. at MIT. He has been following this case since it started. He has a site called "The Witch Hunt Information Center" and on that site he has interviewes he has had with people involved with the case as well as transcripts of the case and transcripts of the interviews done on the children. I believe that the addy is www.geocities.com/jgharris7/fells.html If that doesn't get you there, I got the site from a search at yahoo typing in fells acre.

I live twenty minutes away from were the school was and remember clearly when this case started. It was in the early eighties and even then it was unbelievable! Two judges, lawyers and others have said that it was a travesty of justice. Here in Salem we have called it the second Witch Hunt and the name has caught on. At the trial of the mother and sister the judge who was sitting on the bench sentenced them to 8-10 years but told them if they were not paroled on their first try he would reduce their sentence to 5 years. They weren't paroled so he kept his promise. The reduction of sentence was overturned. Gerald Amirault was sentenced in a seperate trial after his mother and sister's to 30-40 years with parole in 20 years.

If you go to this site you will be shocked at the way the case was handled. If you can't get to the site I will try to post the information I have. I told Scott that this man should be the poster boy of male rights.

Vi Amirault and her daughter won on appeal because the children where positioned so they could not be seen by the defendents. During Geralds case the children were in the same position but his appeal was denied.

The evidence in this case was weak and the medical evidence, 3 girls had vaginitis, was viewed by a pediatric gyn to be very significant and unsusual to be found in 3 girls from the same school. She felt that it was indicitive of sexual abuse. What was not stated at the trial is the gyn doc had written a book before the trial stating that vaginitis is common in children that age and that it can be caused by hygene problem and poor fiting clothes. It was also stated in the book that it goes away in 3-4 weeks. An intesting fact considering that one of the girls had not been to the Fells Acres for 18 months when the doctor examined her and the other two had not been at the school for over 4 months. This medical evidence was considered very significant to the defendents conviction.

When Gov. Swift refused to commute Gerald's sentence she stated that she and her staff studdied 100 sexual abuse convictions and the evidence in the case and in good conscience could not release him. She stated that looking at his record in prison she could see that he has not been rehabilitated and that he could still be a threat to the community. This is based on the fact that he has never admitted to the abuse.

The "abused" children have been brought out to give statements. They are now in their early twenties. They believe that they are emotionaly damaged and that the release of Gerald would make them even worse.

This poor man is still siting in jail because the he is taking the fall for the real abusers, the social workers, police, and prosecutors.

Wasn't she the woman who had twins right before becoming governor [she'd been lt. governor, the gov got elected to elsewhere] and had her staff babysit them and other annoying things? Or am I getting her confused with someone else?
